Terms of Services

Article 1 (Purpose)

These terms of service (“the Terms”) set forth the conditions for using the online system “my HIOKI,” a free service provided by Hioki E.E. Corporation (“Hioki”) to customers (“Members”) who register on the website (www.hioki.com) managed and operated by Hioki. These Terms apply when Members use the Service.

Article 2 (Purpose of the Service)

The purpose of the Service is to strengthen communication between Members and Hioki by building a real-time database for use by Members and to accelerate business development for both parties through two-way information exchange.

Article 3 (Membership Registration)

  • 1. Applicants for membership registration (“Applicants”) must agree to these Terms and apply to use the Service by entering the required information in a designated membership registration form (“Membership Registration Form”) on the website specified in Article 1. Hioki will review the content entered in the Membership Registration Form and, if the registration is approved, send a notification to the Applicant’s email address. The Applicant must then complete the registration procedure by receiving the notification and entering detailed information. However, Hioki will decline to approve registration requests in the following cases:
    • (1)If the Applicant provides false information during registration
    • (2)If the Applicant’s account previously has been suspended or canceled due to violation of these Terms or for similar reasons
    • (3)If the Applicant has already completed the registration process
    • (4)If the Applicant does not exist, or
    • (5)If Hioki determines that the registration cannot be approved for other reasons
  • 2.Hioki may choose not to disclose the reason for not approving a registration.
  • 3.Personal information entered by the Applicant in the Membership Registration Form is provided in accordance with Hioki’s Privacy Policy(https://www.hioki.com/privacy-policy/).
  • 4.Members must promptly update their registration if there are any changes to the information they provided.

Article 4 (Nature of the Service)

Members receive the following services provided by Hioki:

  • (1)Downloading materials related to Hioki’s products
  • (2)Receiving information about new products, exhibitions, seminars, and other events
  • (3)Receiving information such as firmware updates for products registered by the Member (“Registered Products”)
  • (4)Downloading calibration documents related to “Registered Products”

Article 5 (Withdrawal from the Service)

  • 1.Members may withdraw from the Service at any time by following a prescribed procedure. The Member will lose membership status upon Hioki’s receipt of the withdrawal request.
  • 2.Hioki may revoke membership at its discretion if it cannot contact a Member due to changes in email address, phone number, or mailing address, or if the Member does not use the Service for three years.
  • 3.Members shall immediately lose membership in the following cases:
    • (1)If the Member violates these Terms
    • (2)If the Member uses the Service improperly, for example by using it as a business tool for personal gain, or if Hioki deems use of the Service to be inappropriate
    • (3)If the Member intentionally enters incorrect information during registration and does not promptly correct it; or
    • (4)If Hioki determines it is necessary to invalidate the membership registration

Article 6 (Prohibited Conduct While Using the Service)

Members must not engage in the following acts while using the Service:

  • 1.Impersonating another Member
  • 2.Registering a product not owned by you as a “Registered Products”.
  • 3.Accessing the Service under the name of an organization without proper representation or authority
  • 4. Engaging in any acts that violate domestic or international laws, whether intentional or unintentional

Article 7 (Suspension or Interruption of the Service)

Hioki may temporarily suspend all or part of Member-facing services without prior notice in the event of any of the following circumstances:

  • 1.If operation of the Service becomes difficult due to force majeure, for example, as a result of a natural disaster
  • 2.If operation of servers, communication lines, or other infrastructure used to provide the Service is halted due to a failure, malfunction, or blackout
  • 3.If regular or emergency inspections or maintenance of the system used to provide the Service are required
  • 4.If required by newly established or revised laws or regulations, or based on decisions by judicial or administrative authorities
  • 5.If Hioki otherwise deems suspension or interruption to be necessary

Article 8 (Amendment or Termination of the Terms)

  • 1.Hioki may revise these Terms by posting changes on its website or by other means deemed appropriate if the revision is deemed to be in the general interest of Members or reasonable in light of the necessity and appropriateness of the changes in question and other relevant factors. The revised Terms will apply from the effective date of the revision.
  • 2.If a Member uses the Service on or after the effective date of the revised Terms, the Member will be deemed to have agreed to the revised Terms.
  • 3.Hioki is not liable for any loss or damage incurred by Members due to changes to or termination of the Service.

Article 9 (Miscellaneous Provisions)

Matters not stipulated in these Terms shall be handled, managed, and resolved at the discretion of Hioki.

Article 10 (Governing Law and Jurisdiction)

These Terms and the Service shall be governed by Japanese law. Any disputes regarding these Terms or the Service shall be subject to the exclusive jurisdiction of the Nagano District Court.
